These Terms and Conditions ("Terms") govern your access to and use of the website, contact forms, SMS program, and ambulance coordination services (collectively, the "Services") offered by Larkin Community Hospital, INC ("Larkin Community Hospital," "we," "us," or "our"). By accessing our website, submitting a request, opting in to SMS communications, or otherwise using the Services, you ("you," the "User," or where applicable the "Facility Partner") agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Services.
Read this first. Larkin Community Hospital, INC is a coordination service. We connect Assisted Living Facilities and residents in Miami-Dade County with licensed, third-party ambulance and medical transport providers. We do not own, operate, or staff transport vehicles, and we are not the medical provider rendering transport.
Larkin Community Hospital, INC coordinates ambulance and non-emergency medical transport (NEMT) between Assisted Living Facilities, residents, hospitals, clinics, and licensed transport providers operating in Miami-Dade County, Florida. The Services include intake, triage routing, dispatch coordination with third-party transport providers, ETA communication, and documentation support.
The Services are not a substitute for 911 or emergency medical services. If you, a resident, or any person is experiencing a life-threatening emergency, call 911 immediately. Our contact form, email, and non-dispatch communication channels are not monitored for emergency response. Use of our forms or website does not establish an emergency response relationship.
You must be at least 18 years of age to use the Services. By using the Services, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are submitting a request on behalf of a facility, organization, or another individual, you represent that you have the authority to do so.
If you are an administrator, charge nurse, or other authorized representative of an Assisted Living Facility submitting a request on behalf of a resident, you represent and warrant that:
You have the authority to act on behalf of the facility and, as applicable, the resident or their authorized representative;
You have obtained any consents required under HIPAA, Florida resident-rights regulations, and your facility's internal protocols before sharing resident information with us;
The information you provide is accurate and current to the best of your knowledge; and
You will provide a follow-up Physician Certification Statement (PCS) or other supporting documentation as required by the transport provider or applicable payer.
Larkin ALF Ambulance Service coordinates with independent, third-party transport providers licensed to operate in Florida. We are not responsible for, and do not warrant or guarantee, the clinical decisions, conduct, equipment, performance, or outcomes of any third-party transport provider. Our role is limited to coordination, dispatch routing, and communication. The transport provider remains solely responsible for the rendering of transport services and any clinical care administered during transport.
If you opt in to our SMS program, the following terms apply in addition to the SMS section of our Privacy Policy:
SMS opt-in is voluntary and not a condition of receiving any service.
Message and data rates may apply per your mobile carrier's plan.
Message frequency varies based on activity.
Reply STOP to any SMS to unsubscribe; reply HELP for assistance.
We are not responsible for delays in or non-delivery of SMS messages caused by your carrier, network conditions, or your device.
You agree that text messages may be sent using an automatic telephone dialing system. Your consent is not required to make a purchase or receive Services.
Fees for coordination services, where applicable, are agreed upon separately with facility partners under a service agreement or scope of work. Transport-related charges (ambulance fees, medical transport invoices, and similar) are billed by the third-party transport provider directly to the resident, facility, insurer, or other responsible party, not by Larkin ALF Ambulance Service. We do not authorize, guarantee, or assume responsibility for any transport-provider invoice or balance.
You agree not to:
Use the Services for any unlawful, harmful, or fraudulent purpose;
Submit false, misleading, or impersonating information;
Use the Services to harass, abuse, or harm any person, including our coordinators and transport partner staff;
Attempt to gain unauthorized access to our systems, networks, or data;
Interfere with or disrupt the integrity or performance of the Services;
Use any robot, spider, scraper, or other automated means to access the Services for any purpose without our express written permission; or
Use the Services to transmit any virus, malware, or other malicious code.
All content on this website — including text, graphics, logos, images, and software — is the property of Larkin ALF Ambulance Service or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any portion of the website without our prior written consent, except for personal, non-commercial use.
The services and website are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Larkin ALF Ambulance Service disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant any specific dispatch time, arrival time, response time, or outcome.
To the maximum extent permitted by Florida law, in no event shall Larkin ALF Ambulance Service, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, personal injury, property damage, or any damages arising out of or in connection with the use of, or inability to use, the services, even if advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising out of or relating to these terms or the services shall not exceed the greater of (a) the amount you paid to us, if any, in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Nothing in these terms limits liability for fraud, willful misconduct, or any liability that cannot be limited or excluded under applicable law.
You agree to defend, indemnify, and hold harmless Larkin ALF Ambulance Service and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of, or access to, the Services; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any privacy or intellectual property right; or (d) any claim that information you provided caused damage to a third party.
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles. You agree that any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you irrevocably submit to the personal jurisdiction of those courts.
Before initiating any formal legal proceeding, you agree to first contact us and attempt in good faith to resolve any dispute informally for a period of at least thirty (30) days. If the dispute cannot be resolved informally, either party may proceed to litigation in accordance with § 12. Nothing in this Section prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction.
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination — including but not limited to intellectual property, disclaimers, limitation of liability, indemnification, and governing law — shall survive.
We may revise these Terms at any time by updating this page. Material changes will be communicated via our website and, where appropriate, to facility partners directly. Your continued use of the Services after any modification constitutes acceptance of the revised Terms.
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy and any applicable service agreement executed between Larkin ALF Ambulance Service and a Facility Partner, constitute the entire agreement between you and us with respect to the Services and supersede all prior or contemporaneous communications.
